It's a fact that we all find difficult to face, but anyone can become unable to manage their affairs at any stage of life. Whether the cause is accident, sickness or mental illness, everyday activities such as managing bank accounts, paying bills and even simple personal care may become impossible without assistance. A Power of Attorney allows someone else that you trust to deal with things on your behalf, should the need arise.
There are essentially two types of Power of Attorney: a General Power of Attorney and an Enduring Power of Attorney. A General Power of Attorney cannot be used if the person becomes mentally incapable and its purpose is simply to let someone temporarily manage their general affairs (e.g. sign their cheques to pay the bills). An Enduring Power of Attorney can, however, be used even after someone becomes mentally incapable providing there is evidence to show that the person was mentally capable at the time of signing the Power of Attorney.
